Privacy Policy

Right of Withdrawal

Unless otherwise stated in the exceptions listed below, the CUSTOMER is entitled, as a general principle, to exercise their right of withdrawal by returning or restoring the PRODUCT to ATM GAMING. To do so, the PRODUCT must be returned or restored without undue delay, and no later than fourteen (14) days following the communication of their decision to withdraw.

Withdrawal Period

In accordance with Article L.221-18 of the French Consumer Code, the withdrawal period expires fourteen (14) days after the day on which the CUSTOMER, or a third party other than the carrier and designated by the CUSTOMER, takes physical possession of the PRODUCT.

If the CUSTOMER's order covers several PRODUCTS or if those PRODUCTS are delivered separately, the withdrawal period expires fourteen (14) days after the day on which the CUSTOMER, or a third party other than the carrier and designated by the CUSTOMER, takes physical possession of the last PRODUCT.

Notification of the Right of Withdrawal

To exercise their right of withdrawal and in accordance with Article L.221-21 of the French Consumer Code, the CUSTOMER must notify their decision to withdraw by means of an unambiguous statement (for example, a letter sent by post, fax, or email) to: contact@atmgaming.com or to ATM GAMING - 13 Boulevard Haussmann – 75009 Paris.

In order for the withdrawal period to be respected, the CUSTOMER must submit their communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

Effects of Withdrawal

In the event of withdrawal by the CUSTOMER, ATM GAMING undertakes to reimburse all sums paid, including delivery costs (with the exception of additional costs arising from the CUSTOMER's choice, where applicable, of a delivery method other than the least expensive standard delivery method offered by ATM GAMING), without undue delay and, in any event, no later than fourteen (14) days from the day on which ATM GAMING receives the returned PRODUCT. (Article L.221-24 of the French Consumer Code).

ATM GAMING shall proceed with the reimbursement using the same payment method as the one used by the CUSTOMER for the initial transaction, unless the CUSTOMER expressly agrees to a different method; in any event, such reimbursement shall not incur any costs for the CUSTOMER.

ATM GAMING is not required to reimburse additional costs if the CUSTOMER has expressly chosen a delivery method more expensive than the standard delivery method offered by ATM GAMING.

ATM GAMING may defer the reimbursement until receipt of the PRODUCT or until the CUSTOMER has provided proof of dispatch of the PRODUCT, whichever occurs first.

Return Procedure

The CUSTOMER must, without undue delay and, in any event, no later than fourteen (14) days after communicating their decision to withdraw from this contract, return the PRODUCT to: ATM GAMING - 13 Boulevard Haussmann – 75009 Paris.

This deadline shall be deemed met if the CUSTOMER returns the PRODUCT before the expiry of the fourteen (14) day period.

Return Costs

The CUSTOMER shall bear the direct costs of returning the PRODUCT.

Condition of the Returned PRODUCT

The PRODUCT must be returned in accordance with ATM GAMING's instructions and must include, in particular, all accessories delivered with it.

The CUSTOMER's liability shall only be engaged with respect to the depreciation of the PRODUCT resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the PRODUCT. In other words, the CUSTOMER may test the PRODUCT, however their liability may be engaged if they carry out handling beyond what is strictly necessary.

Exclusions from the Right of Withdrawal

The right of withdrawal is excluded in the following circumstances:

  • Supply of goods or services whose price depends on fluctuations in the financial market

  • Supply of goods made to the CUSTOMER's specifications or clearly personalised

  • Supply of goods liable to deteriorate or expire rapidly

  • Supply of sealed audio or video recordings or software which have been unsealed after delivery

  • Newspapers, periodicals, or magazines (except subscription contracts)

  • Provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, or services related to leisure activities where the offer provides for a specific date or period of performance

  • Supply of goods which by their nature are inseparably mixed with other items

  • Supply of sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the CUSTOMER after DELIVERY

  • Supply of alcoholic beverages whose price was agreed upon at the time of conclusion of the sales contract, the delivery of which cannot be carried out until after 30 days, and whose actual value depends on fluctuations in the market beyond the seller's control

  • Supply of digital content not provided on a tangible medium if performance has begun with the CUSTOMER's prior express consent, and the CUSTOMER has also acknowledged that they will thereby lose their right of withdrawal

  • Contracts concluded at a public auction
